Předmět: Výzva senátorkám a senátorům ve věci zdanění výsluhových náležitostí

Važená paní senátorko,
Vážený pane senátore,
věřím, že na Vaší 25. schůzi, která začíná zítra – tedy jeden den po Dni válečných veteránů – nedáte mnohým válečným veteránům "dárek" v podobě prohlasování protiústavního zdanění výsluhového příspěvku, které je součástí senátního tisku č. 366 (novela zákona č. 586/1992 Sb., o daních z příjmů).
Konkrétní důvody, pro které - nejen já - považuji zdanění výsluhového příspěvku za protiústavní, jsou uvedeny v přílohách k tomuto emailu a obecně jsou pak shrnuty v preambuli FB skupiny „Výsluha versus právní stát“ - http://www.facebook.com/group.php?gid=163607773653545 (záložka "Informace").
Uvedené zdanění 15% srážkovou sazbou se však netýká pouze válečných veteránů, ale i několika desítek tisíc vysloužilých i aktivních vojáků, policistů, celníků, hasičů, celníků, příslušníků vězeňské služby, justiční stráže, BIS a ÚZSI. Tedy všech, kteří se bezprostředně podíleli a podílejí na zajišťování bezpečnosti České republiky při zajišťovánání její svrchovanosti a územní celistvosti, při ochraně jejích demokratických základů, při ochraně životů, zdraví a majetkových hodnot.
Vážené senátorky, vážení senátoři, buďte, prosím, uvážliví při Vašem hlasování o novele daňového zákona a nepřipusťte ohrožení principu právní jistoty, principu ochrany nabytých práv, principu nepřípustnosti retroaktivity, principu zákazu diskriminace a principu dodržování zásady „pacta sunt servanda“ ve vztahu veřejné moci k občanovi, tedy osvědčených právních principů, které jsou podstatnou náležitostí demokratického právního státu.
